1. Introduction
Welcome to StampChat, a service operated by Lunarvia (Pty) Ltd ("we", "us", or "our"). These Terms of Service ("Terms") govern your use of StampChat, including our website, WhatsApp integrations, and related services (collectively, the "Service").
By accessing or using StampChat, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use the Service.
2. Eligibility
To use StampChat, you must:
- Be at least 18 years old.
- Use the Service on behalf of a legitimate business.
- Have authority to bind that business to these Terms.
3. Description of Service
StampChat is a WhatsApp-based loyalty and customer engagement platform that enables businesses to connect with customers through loyalty rewards, messages, and QR-based interactions.
We offer paid subscription plans with various features, analytics, and business tools. We may, at our sole discretion, provide trial or promotional access for testing purposes. StampChat integrates with Meta's WhatsApp Cloud API, and you acknowledge that WhatsApp policies or availability may impact the Service.
4. Account Registration
When creating an account, you agree to:
- Provide accurate and complete information.
- Keep your login credentials secure.
- Notify us of any unauthorised access immediately.
You are responsible for all activity under your account.
5. Acceptable Use
You agree not to:
- Use the Service for spam, fraud, or unlawful content.
- Violate WhatsApp's Business Platform Policies.
- Interfere with or disrupt the Service.
- Access or attempt to access another user's data.
- Reverse-engineer the Service or its components.
6. Subscription Plans and Payments
StampChat offers paid subscription plans billed monthly in South African Rand (ZAR). By subscribing, you authorise us to charge your selected payment method on a recurring basis until you cancel. Failure to pay may result in suspension of your account.
We reserve the right to change pricing with 30 days' notice to existing subscribers.
7. Intellectual Property
All content, branding, software, and technology forming the Service are owned or licensed by Lunarvia (Pty) Ltd. You may not copy, distribute, or modify any part of the Service without our written consent.
You retain ownership of your business data. By using the Service, you grant us permission to store and process your data solely for providing the Service.
8. Privacy
Please review our Privacy Policy to understand how your information is collected, processed, and protected in accordance with POPIA.
9. Service Availability
We work to keep StampChat available at all times, but uninterrupted service is not guaranteed. We are not responsible for downtime caused by WhatsApp outages, network failures, maintenance, or third-party disruptions.
10. Termination
We may suspend or terminate your account if you:
- Breach these Terms.
- Fail to pay subscription fees.
- Misuse the Service.
- Violate WhatsApp policies.
You may cancel your account at any time through your account settings or by contacting us.
11. Limitation of Liability
To the fullest extent permitted by law, Lunarvia (Pty) Ltd is not liable for loss of data, revenue, or profits, or for any indirect or consequential damages. Total liability is limited to the amount paid by you in the previous three months.
12. Indemnity
You agree to indemnify Lunarvia (Pty) Ltd against claims arising from misuse of the Service, breach of these Terms, or non-compliance with WhatsApp or POPIA requirements.
13. Changes to These Terms
We may update these Terms periodically. We will notify active subscribers of material changes via email or in-app notification. Continued use of the Service after updates constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of South Africa. Any disputes will be resolved in South African courts.
15. Refund & Cancellation Policy
15.1 Cancellations
You may cancel your subscription at any time. Your plan will remain active until the end of the current billing cycle.
15.2 No Refunds
Payments are non-refundable, including for unused time or plan downgrades.
15.3 Exceptional Circumstances
Refunds may be issued at our discretion in rare cases, such as verified technical issues preventing access to the Service.
